A Call For A Congressional Investigation of SGT Boyle and 1LT Behenna’s Court-Martials

Dear Congressman King:

You have received many letters, emails and phone calls from me over the past year; all regarding the wrongful conviction of my son, Justin Boyle. While I wait impatiently for my son’s appeals process to begin, I feel compelled to write to you on behalf of another hero, 1LT Michael Behenna.

1LT Behenna is currently serving a 15 year sentence at Fort Leavenworth, convicted of unpremeditated murder and assault of an al- Qaida operative.
In Michael’s case the Government withheld testimony of their own forensic expert, Dr. Herbert MacDonnell because he was going to testify that Michael was telling the truth when he said that he acted in self defense. Dr. MacDonnell said the forensic evidence was consistent with Michael’s testimony that Ali Mansur was standing with his arms outstretched when shot.
Instead of allowing Dr, MacDonnell to testify the prosecutors sent him home. Dr. MacDonnell contacted the prosecutors and requested that his information be shared with the defense, but the information was not given until after a verdict was reached. Lt. Behenna was convicted of unpremeditated murder and assault by a military panel of seven officers, none of whom had combat experience.

Prior to sentencing the judge allowed Dr. MacDonnell to provide his information to the court via telephone. After hearing the testimony of Dr. MacDonnell, the judge ordered both sides in the case to file briefs relating to a possible mistrial. After reading the briefs the judge set an additional hearing and ordered additional briefs, including one from the defense requesting a new trial. The judge denied defense motions to declare a mistrial and to order a new trial.
Michael was sentenced to 25 years (the 25 year sentence was reduced five years by the commanding general of 101st Airborne and reduced another five years by the Army Clemency Board.)

Congressman King, though Michael and his family are residents of the state of Oklahoma, and not your constituents, I think Michael Behenna is yet another victim of unlawful command influence and his case and along with my son’s should be the subject of a congressional investigation.

A Night to Remember

On Friday, October 29, 2010 I completed a long awaited journey home to New York with my son, my husband and my son’s fiancé. The reception that greeted us is something that will be forever in my heart and at this time I need to say thank you to many people that made this joyous occasion possible.

My first thank you goes out to the Brown family. While they mourned the death of theirloved one, they did everything they could to try to prevent the army from prosecuting any of the soldiers involved and continued to try to prevent my son from going to jail and being discharged from the army. They are an amazing family and I will be eternally grateful to Michelle Brown and her family for their courage and compassion at my son’scourt-martial and all those that followed. One of the reasons clemency was granted wasbecause of Michelle Brown’s testimony.

There are so many people who have done so much to support my son over the last 13 months. My web master that created and maintained the justice4justin website; family and friends that took the time to write letters of support for clemency, those that supported him through donations to the defense fund and attendance at the fundraiser, those that signed his petition, those that became his FB friend and joined the FB group Justice 4 Justin, those that placed a bumper sticker on their car, those that wrote to him, those that visited him, and those that came out to welcome him home.

Although I am not a veteran, on Friday, October 29, I had the chance to experiencea phenomenal event; the brotherhood and sisterhood of veterans and their families. It was an experience I will never forget. Paratroopers that served with my son drove upfrom North Carolina, Virginia and Ohio. Two of these troopers also took the long drive toOklahoma to save my son from the humiliation of being taken to prison in handcuffs andshackles on a commercial airliner. Volunteers from the Patriot Guard Riders, the BlueStar Moms Chapter 6, 911 Veterans and veterans from many military organizations were on hand to welcome Justin home at JFK airport. This gathering would have never been possible without the assistance of the Port Authority Police. Thank you officers!!

After the overwhelming ceremony at the Delta terminal that included a sea of America flags and chants of “HOOAAH SGT Boyle”, we moved to the vehicles for the long ride to Rocky Point. Those were the most amazing miles I have ever ridden.
The family cars were secured between motorcycles and road masters and led throughthe streets of Long Island by police escorts. Fire Departments along the route displayed American Flag arches and saluted SGT Boyle as he passed beneath the Stars and Stripes. Thank you to all those police officers and firefighters that volunteered their time to make my son’s welcome home unforgettable.

The motorcade ended at the Rocky Point VFW, an appropriate place to welcome home a war hero. There, I got the chance to speak with many of the Patriot Guard Riders,Blue Star Moms, 911 Veterans, members of the Rocky Point VFW and family and friends that came out to help welcome home SGT Boyle.

Assemblyman Dean Murray attended and gave Justin a citation “for his dedication,commitment and service to his country.” Steve Clark from 911 Veterans made a speech and asked that all veterans groups band together to form a united front to help call attention to the needs of all veterans.

A remarkable Gold Star Mom came out to welcome my son home just weeks before the third anniversary of her son’s death.

I WAS IN AWE! As I listened to the speeches and watched the handshakes and hugs going on around me I saw and felt the connection between these band of brothers andsisters. From WWII and Vietnam to Iraq and Afghanistan, the men and women in the room had an unspoken bond. They came out to support one of their own, they are a family.

The night would not have been complete without our family and friends that have been there for us from day one. They stepped up and hung banners and signs, baked and setup refreshments and generally made the evening a lot more enjoyable.

Thank you all for a night to remember.

Patriot Guard Riders are bringing Justin Home!

The Patriot Guard Riders will be at JFK International Airport on October 29 to give Justin a hero’s welcome home. The Boyle family would like to thank all the volunteer members of the PGA who are giving of their time that day to honor our son. God Bless each and every one of them.

Justin granted clemency

The Boyle family received a much anticipated message last night, “The commanding general granted the clemency—although not entirely.  Your son will be released from confinement on 28 October 2010.”

On October 5, Justin will be in prison for one year.  Throughout the year the family and friends of SGT Boyle have been working very hard to get him released.  A website was set up, a Face book page was launched, a petition was created, letters were written, phone calls were made and emails were sent, meetings were held, congressmen got involved, newspaper articles were written, TV news reports and radio shows were broadcasted, bumper stickers, pins and tee-shirts were adorned, a defense fund was set up, fundraisers were held and generous donations were made; all of this in an effort to Free SGT Boyle.

While his supporters worked tirelessly on the outside, SGT Boyle did something very important on the inside; he never forgot who he was. 

It was Justin’s testimony and conduct during a trial at Fort Sill that caught the attention of a noble JAG officer.  Justin was doing nothing more than being himself; conducting himself in the same manner he always has, with integrity.  

This noble officer spoke to Justin after the trial and was gracious enough to contact Mrs. Boyle to tell her he was recommending clemency for Justin.  

Major General Halverson granted Justin partial clemency and the Boyle family would like to extend their gratitude to the General for doing so.

All Fired Up: Internet talk show host Betty Kilbride takes on Justin’s Case

All Fired Up!, an internet talk-show, was hosted by Betty Kilbride for their Military Monday piece and our military justice system was the focus of the show, with Justin’s case being the example. Listen as she talks though all the issues and setbacks.
